Terms of Service

1. What EverPlan is

EverPlan, operated by HyperianLabs, is an AI-guided tool that helps you organize your estate-planning information and generate a draft will and supporting documents. EverPlan is a software platform, not a law firm — using it does not create an attorney-client relationship, and nothing you receive from it is legal, financial, or medical advice.

2. Eligibility

You must be at least 16 years old — the minimum age to make a valid will under South African law — and currently EverPlan is designed around South African law and execution requirements only.

3. Your account

You're responsible for the accuracy of the information you enter, for keeping your login credentials confidential, and for enabling two-factor authentication (strongly recommended). Tell us immediately at everplan@hyperianlabs.com if you believe your account has been accessed without authorization.

4. Documents you generate are not valid until properly executed

A document generated by EverPlan has no legal effect on its own. South African law does not currently permit electronic signature or remote online notarization for wills — your document must be signed in wet ink, in the physical presence of the required witnesses, following the execution guide in your account. You are solely responsible for ensuring your document is executed correctly; EverPlan verifies witness eligibility rules but cannot verify that execution actually happened correctly.

5. Capacity affirmation

Before finalizing certain documents, you'll be asked to affirm that you are completing them of your own free will, without pressure from anyone else, and that you understand their contents. This affirmation is recorded against your account.

6. Family and executor access

You control what family members can see. Executor access requires supporting evidence and manual review before it's granted. Being granted access through EverPlan does not itself confer legal authority to act as an executor — that authority comes only from Letters of Executorship, Letters of Authority, or a court order issued by the Master of the High Court. EverPlan is not a party to and takes no responsibility for how family members or executors use information they're given access to.

7. Subscriptions and payments

Subscription plans renew automatically at the interval you selected until you cancel, and are billed through Paystack. If we ever raise the price of your plan, your existing subscription keeps its price at the rate you originally subscribed at, for as long as your subscription stays continuously active.

One-time purchases (such as Finalize & Execute) unlock the associated feature permanently once payment succeeds, independent of any subscription.

8. Referral services

Where EverPlan connects you with a partner (such as attorney review or expedited service), that service is provided by the partner directly under their own terms — EverPlan facilitates the introduction but is not the provider of that service.

9. Intellectual property

EverPlan™ is a trademark of HyperianLabs. The EverPlan software, design, and content are owned by HyperianLabs. The documents you generate using your own information belong to you.

10. Termination

You can close your account at any time. We may suspend or terminate an account that we reasonably believe is being used fraudulently, abusively, or in violation of these terms.

11. Limitation of liability

12. Governing law

These terms are governed by the laws of South Africa.

13. Changes to these terms
